ANASA Retreats Limited – Terms & Conditions
- Introduction
- – Please read these Terms and Conditions (the “Terms”) carefully before booking your retreat.
- – In these Terms “we”/”us”/”our” means ANASA Retreats Limited, whose registered office is Apartment 423 River Crescent, Waterside Way, Nottingham, NG2 4RH, UK and whose company number is 15885710. “you”/”your”/”yours” means you, the client.
- – All Pilates & Wellness Retreat Packages (the “Retreat“) provided by us, ANASA Retreats Limited, are provided subject to these Terms.
- – By signing the Terms, ticking the accept box online or making a booking for a Retreat, you are confirming that you have read the Terms and agree to be bound by them.
- – Anasa Retreats Limited does not itself own or provide any of the accommodation services or facilities which make up your Retreat. These are provided by third parties whom we arrange to provide the services, facilities or travel arrangements which make up your Retreat (the “Retreat Providers”). The terms and conditions of the Retreat Providers shall also therefore apply to your Retreat booking.
- Fitness and Health
- – It is your sole responsibility to notify us before attending any Retreat of any circumstances affecting your health which may be exacerbated through your attendance at a Retreat.
- – You must complete a form (the “Health & Safety Questionnaire”) at the time of booking the Retreat. This will record details, as stated by yourself, as to your current state of health, any medical conditions you have and any medication you are taking. It is your responsibility to ensure the Health & Safey Questionnaire is completed and is truthful to reflect your current condition. It is your responsibility to keep your responses to the Health & Safety Questionnaire up to date and to update your responses if your condition has changed.
- – Please note that after the Health & Safety Questionnaire has been completed, we may decide that we cannot accept your booking for the Retreat. For example, if any form of training or exercise we can offer is not suitable for you or if the form and type of training and exercise you require is not medically safe for you to undertake. In such cases we will require you to consult with a medical doctor (such as your GP) and before we can provide any services to you, we will require a report or letter from a medical doctor to indicate that you can undertake exercise and training.
- – It is advised not to undertake any strenuous physical activity without first seeking medical advice if you have any concerns over your physical condition or wellbeing. If there is any doubt, you should consult your doctor.
- – By booking a Retreat, you confirm that:
- – you are physically able to attend a Retreat and that none of the medical conditions set out in clause 6 apply to you; or
- – if one of the medical conditions set out in clause 6 does apply to you or you have knowledge of any pre-existing medical conditions, that you have sought medical advice, that a medical practitioner has confirmed that you are physically able to attend the Retreat and you have provided details of such medical conditions in your completed Health & Safety Questionnaire.
- – The medical conditions referred to in clause 5 are as follows:
- – a doctor or medical professional has ever diagnosed you with a heart condition and indicated that you should restrict your physical activity;
- – when performing physical activity you frequently feel pain in your heart and/or chest;
- – in the past month, when you are not engaging in physical activity, you have experienced heart and/or chest pain;
- – you ever faint or get dizzy and lose your balance;
- – you have an injury or orthopaedic condition, such as a back, hip or knee problem, which may worsen due to a change in physical activity;
- – you have high blood pressure and/or a heart condition in which a doctor or medical profession is currently prescribing medication;
- – you are pregnant or think you may be pregnant;
- – you have insulin dependent diabetes;
- – you are over age of 65 and not accustomed to vigorous exercise; or
- – you know of any other reason why exercise or increasing your physical activity may adversely affect your health.
- – We reserve the right to refuse access to anyone if, in our absolute discretion, we consider that the health of the individual concerned may be endangered by attending the Retreat or participating in any activities or excursions at the Retreat.
- – You are required to follow the instructions of the instructor at all times. We will not be responsible for any medical issues that may arise during the Retreat.
- Booking and Payment
- -Bookings for Retreats can be made through our website or by emailing us and completing the booking with a BACS payment of the deposit.
- -You must be at least 18 years of age to attend any Retreat with us.
- -The price for each Retreat will be shown clearly on the website. A non-refundable deposit of £500 per person is required to secure your booking.
- -The full balance is due 4 months prior to the Retreat start date. Failure to pay the balance by this date may result in cancellation of your booking and the loss of your deposit.
- -Bookings made within the 4 months of the Retreat start date require full payment at the time of booking.
- -Payment can be made by bank transfer. Prices are quoted in GBP [£] and are inclusive of VAT (20%).
- -We reserve the right to alter prices due to unforeseen circumstances, such as significant fluctuations in exchange rates or increases in supplier costs. Any price changes will be communicated to you as soon as possible. If the price of your Retreat is increased by more than 8% of its total price, then you may:
- -accept and pay for the price increase;
- -reject the price increase and terminate your booking with a full refund; or
- -reject the price increase, terminate your booking and take an alternative Retreat if we decide to offer this. If you decide to take an alternative Retreat, we will inform you of its impact on the price of your booking. If the alternative Retreat is of a lower quality or cost, you may be entitled to a price reduction. We will give you a reasonable period of time to make your decision, which will usually be 7 days from notification of the price increase. If we do not hear from you within this timeframe, we shall send a reminder to you, following which we shall be entitled to terminate the Retreat and provide you with a refund.
- -Your booking is not complete until you have received a booking confirmation from us. Our acceptance of your booking takes place when we send an email to you to accept it, at which point and on which date the contract between you and us will come into existence. Please make sure you receive the booking confirmation before you attend the Retreat. If you do not receive a booking confirmation please contact us by phone or e-mail.
- -If we are unable to accept your booking, we will inform you of this by email and will refund your payment and not charge you for the Retreat you applied for. This might be because of unexpected limits on our resources which we could not reasonably plan for, or because we have identified an error in the price or description of the Retreat.
- -All Retreats are offered by us subject to availability at the time of booking. We try hard to make sure that our website is kept up to date, but we do not guarantee that any of the Retreats we advertise will still be available at the time of booking. We will inform you as soon as possible after you place a booking if, for any reason, the Retreat you have sought to book with us is not available.
- Changing or Cancelling your Booking
- -Cancellations must be made in writing and sent to [email protected] or [Apartment 423, River Crescent, Waterside Way, Nottingham, NG2 4RH, UK].
- -The following cancellation charges will apply:
- -4 months or more prior to the Retreat start date: Loss of deposit.
- -4 months to 2 months prior to the Retreat start date: 60% of the total Retreat cost.
- -Less than 2 months prior to the Retreat start date: 100% of the total Retreat cost.
- -No refunds will be given for cancellations made after the Retreat start date or for any unused portion of the Retreat.
- -You may transfer your booking to another person who satisfies all the conditions applicable to the Retreat, subject to you and the other person accepting that you will both be liable, jointly and individually, for full payment of any balance due to be paid and any fees, charges or other costs arising from the transfer. We shall notify you of these costs upon receipt of your request to transfer. In order to take advantage of this possibility, you must contact us at the details set out in clause 8. You will need to give us reasonable notice of this change so that we can make the necessary arrangements, but 28 days before departure for the Retreat shall be considered to be reasonable.
- -In addition to the cancellation right set out above, you shall have the right to cancel your booking before the start of the Retreat without paying any cancellation charge in the event of an Event Outside Our Control, occurring at the place of destination or its immediate vicinity, where we have confirmed to you that they will significantly affect the performance of the Retreat, or that they will significantly affect the carriage of passengers to the destination. If you cancel in this circumstance, we shall provide you will a full refund of any payments made in relation to your booking but you will not be entitled to compensation.
- If we cancel your booking
- -We reserve the right to cancel the Retreat due to unforeseen circumstances, including but not limited to: insufficient bookings, natural disasters, political instability, or force majeure.
- -In the event that we cancel a Retreat that you have booked, we will make reasonable efforts to contact you by email or telephone to let you know.
- -We will offer you the choice between:
- -a full refund; or
- -being transferred to another Retreat at an alternative date and time (subject to availability and any price difference).
- -We will not be liable for any costs incurred by you as a result of the cancellation, including travel or accommodation expenses.
- The Retreat Package
- -The Retreat Package includes:
- -accommodation for the duration of the Retreat.
- -all excursions listed on our website for the specific Retreat package that you have purchased and all the excursions which will take place during the Retreat as a group excursion organised by Anasa Retreats Limited.
- -all the group Reformer and group Mat Pilates sessions listed in the itinerary of the specific Retreat package that you have purchased as specified on the website and all the Reformer and Mat Pilates sessions which will take place during the Retreat as a group activity organised by Anasa Retreats Limited.
- -all activities listed in the itinerary of the specific Retreat package that you have purchased as specified on the website and all the activities which will take place during the Retreat as a group activity organised by Anasa Retreats Limited.
- -transportation required as part of the group agreed activities and excursions organised by Anasa Retreats Limited.
- -2 meals per day.
- -potable water for the duration of the Retreat.
- -The Retreat Package does not include:
- -accommodation before the check-in time or after the check-out time.
- -transportation from and to the Retreat location (including flights etc).
- -transportation from and to the airport/port/bus terminal or other location or accommodation.
- -transportation during the Retreat for personal purposes, personal activities, activities which are not conducted as a group, activities not listed in the itinerary and activities not organised by Anasa Retreats Limited.
- -any personal training and private 1:1, 2:1 or 3:1 sessions.
- -any excursions or activities which are not listed in the itinerary and not conducted as a group and not organised by Anasa Retreats Limited.
- -any meals which are not listed in the itinerary and not provided as a group meal and not organised by Anasa Retreats Limited.
- -any purchases of food or beverage.
- -purchase or consumption of alcoholic drinks.
- -travel insurance.
- -spa treatments, unless specified differently in the specific package.
- -personal expenses.
- -any other exclusions which are clearly listed on the website under the specific Retreat package’s Exclusions section.
- -The Retreat Package includes:
- Travel and insurance
- -You are responsible for making your own travel arrangements to and from the Retreat location, unless otherwise specified in your booking. If the transportation to and from the Retreat location is included, then it will be specifically stated as an exception of that particular Retreat package.
- -It is recommended that you have comprehensive travel insurance that covers medical expenses, cancellation, curtailment, and repatriation. Please ensure that you have a valid travel insurance policy in place from the time of booking, to cover you for the countries and activities you may be undertaking on your Retreat. Proof of insurance may be required.
- -We will not be responsible for any travel delays or disruptions.
- -Please note that we can provide general information about the passport and visa requirements for your trip, but your specific passport and visa requirements, and other immigration requirements are your responsibility and you should confirm these with the relevant embassies and/or consulates. Any information supplied by us on these or related matters (such as climate, when to travel, clothing, baggage, personal items etc.) is given as general guidance and in good faith but we do not accept liability for any decisions made on the basis of the information supplied.
- -The passport, visa and health requirements in respect of UK citizens at the time of booking can be viewed on the Foreign and Commonwealth Office website (www.gov.uk/foreign-travel-advice). It is your responsibility to ensure that you are in possession of all necessary & valid travel and health documents, and in compliance with any other immigration requirements, before you travel including whether your passport must be machine readable or which visas/waivers may be required for entry such as ESTA for USA travel and/or ETIAS for EU travel. We cannot accept any responsibility if you cannot travel because you have not complied with any passport, visa, health or immigration requirements.
- How You Should Contact Us
- -Any written notice or completed form should be e-mailed to [email protected].
- -You can contact us by email at [email protected] or in an emergency by telephone on +44(0)7443326669 or +44(0)7586735508. Your emergency contact whilst on the Retreat can be found in your booking confirmation.
- -We may contact you using any of the contact details you provide to us when you make your booking, which may include via email, telephone or text message. Our Privacy Policy sets out how we may process your personal data, which includes the contact details you provide to us.
- Data Protection Notice
- -We will use any personal information you provide to us to:
- -provide the Retreat;
- -process your payment for the Retreat; and
- -inform you about similar products or services that we provide, but you may stop receiving these at any time by contacting us.
- -We will process your personal information in accordance with our Privacy Notice at www.anasapilates.co.uk, the terms of which are incorporated into this contract.
- -You are required to give written notice to us of any change of address. Failing such notice, all communications will be assumed to have been received by you within five days of mailing to the last address notified to us.
- -We may, if you so wish, communicate with you by electronic mail (“email”). By providing an email address to us, you thereby consent to receiving email communications from us, including notices pursuant to these Terms. You also accept the risk that email may not be a secure and confidential means of communication. We will not be liable for any loss or damage suffered as a result of communicating with you by email.
- -By accepting these Terms, you consent and agree to the video recording / photography of the Retreat you attend and consent to the video recordings/photographs being used for marketing purposes on social media and other marketing material by ANASA Retreats Limited.
- -If you do not wish to be photographed or filmed, please inform us in writing before the Retreat.
- -Any marketing, educational or other materials of any nature whatsoever produced by us in connection with the Retreat and which are made available to you will at all times remain the property of ANASA Retreats Limited and will be subject to our copyright.
- -We will use any personal information you provide to us to:
- Conduct and Safety
- -You must at all times observe the Retreat guidelines which may be notified to you from time to time and are requested to comply with any reasonable directions which the management of the Retreat may issue to ensure the smooth operation of the Retreat for the convenience of all attending it.
- -We shall provide you with appropriate assistance without undue delay if you are in difficulty, in particular by providing appropriate information on health services, local authorities and consular assistance; and by helping you make distance communications and helping you find alternative travel arrangements. Typically, we do not charge for this assistance, although we do reserve the right to charge a reasonable fee for such assistance if the difficulty has been caused intentionally by you or through your negligence.
- -If you are in difficulty and you need our assistance, please contact us using the details set out in clause 8 above.
- -At any time during an activity or excursion at the Retreat, if in our opinion we consider that:
- – you appear to be unwell or becoming unwell; and/or
- – you appear not to be following my reasonable instructions (such as not following instructions intended to protect your, my or another person’s safety); and/or
- – you are behaving or acting unreasonably or are offensive,
then we may wish to stop the activity/excursion and not continue it.
- – You are expected to behave in a respectful and considerate manner towards other participants and staff.
- – We reserve the right to terminate your participation in the Retreat if your conduct is deemed to be disruptive or inappropriate.
- Our responsibility for the performance of your Retreat
- – ANASA Retreats Limited does not itself own or provide any of the services, facilities or travel arrangements which make up your Retreat. These are provided by third party Retreat Providers. Our role is to exercise reasonable skill and care in making your booking and, to exercise reasonable skill and care in making the arrangements for the Retreat Providers to provide the services, facilities and travel arrangements to you.
- – The combination of travel services offered to you is a package within the meaning of the Package Travel and Linked Travel Arrangements Regulations. Therefore, you will benefit from all EU rights applying to packages. Additionally, as required by law, we have protection in place to refund your payments and, where transport is included in the package, to ensure your repatriation in the event that we become insolvent.
- – You must tell us immediately of any failure to perform or improper performance of your Retreat (“Failure”). This will give us the opportunity to resolve the Failure whilst you are at the Retreat. If we refuse to do so, or if it is necessary to remedy the Failure immediately, then you may resolve the Failure yourself and request reimbursement of reasonable expenses from us. However, these rights will not arise if remedying the Failure is impossible or entails disproportionate costs.
- – If a significant proportion of the travel services included in your Retreat cannot be provided as agreed in the booking, we shall offer, at no extra cost to you, suitable alternative arrangements for the continuation of the Retreat. The alternative arrangements shall, where possible, be of equivalent or higher quality than those specified in your booking. You may only reject the alternative arrangements we offer to you if they are not comparable to what was agreed in the booking.
- – When you buy a Retreat that does not include a flight, protection is provided in the event of our insolvency, by way of our insurance with Tokio Marine HCC (HCC International Insurance Company PLC), The St Botolph Building, 138‐139 Houndsditch, London, EC3A 7BT, Telephone: 020 7680 3000.
- Limitation of liability
- – You will be entitled to an appropriate price reduction for any period during which there is a Failure, unless the Failure is attributable to you.
- – You shall be entitled to receive appropriate compensation from us for any damage you sustain as a result of a Failure except where the Failure is:
- – attributable to you;
- – attributable to a third party unconnected with the provision of the travel services included in the Retreat and is unforeseeable or unavoidable;
- – or due to an Event Outside Our Control.
- – We shall not be liable to pay compensation to you in connection with the Retreat where there are international conventions which limit the extent or the conditions under which compensation would have to be paid by one of our Retreat Providers. These same limitations will apply to us and in an identical manner as if such limitations applied directly to us. These international conventions include (but are not limited to) the Montreal Convention in respect of travel by air (and all earlier related conventions), the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail (Convention concerning International Carriage by Rail (COTIF) of 9 May 1980), the Geneva Convention in respect of travel by road and the Paris Convention in respect of the provision of accommodation. We shall have the full benefit of any limitation of compensation which is contained in these conventions and any other international conventions which govern the travel arrangements which make up the Retreat.
- – If you are granted compensation or a price reduction by another party in relation to the same Failure which you claim compensation or a price reduction from us, then we may deduct the compensation or price reduction you receive from the other party from that which is payable by us.
- – Except as set out above, we accept no liability for any claims, losses, expenses, damages or liability for your Retreat, except in cases involving death, injury or illness where we have caused such damage with negligence.
- – We reserve the right to make alterations to the Retreat, instructors and/or equipment, as well as to those ancillary facilities at the Retreat, provided to you, without notice and in our absolute discretion and we will not be liable for any loss occasioned by such alterations except in so far as such loss is by law incapable of exclusion. We cannot be held responsible for any particular activity, instructor and/or item of Pilates equipment not being available for whatever reason.
- – It is your responsibility to ensure that you are capable of undergoing a routine of exercises provided by any programme which you follow or Retreat you attend. By agreeing to these Terms you accept the risk of injury from performing exercises and using specialist equipment and are advised to consult your doctor prior to attending a Retreat. Advice provided by our instructors at no time constitutes medical advice in substitute for advice provided by a medical professional.
- – Our liability to compensate you (other than in the case of personal injury or death caused by our negligence) will be limited to the cost of the Retreat booking, having regard to such factors as whether the loss or damage was due to a negligent act or omission by us.
- – We accept no liability for loss or damage to your property or for injury whilst at the Retreat or outside the Retreat except insofar as such loss, damage or injury is by law incapable of exclusion by us.
- – In consideration of your participation in the activities and programmes provided by us and the use of facilities and equipment owned by us and/or under our control by agreeing to these Terms you hereby waive and release us from any and all responsibility or liability for injuries or damages resulting from your participation in any of our activities or use of our equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of the ANASA Retreats Limited.
- – You must have signed the online WAIVER form before attending a Retreat. The responsibility of ensuring that these Terms have been read and the online WAIVER form has been signed lies with you. In the case of you failing to sign the online WAIVER form, then we have no responsibility to any legal or insurance claims which may be raised by you.
- – We assume no liability for any COVID-19 related loss, damage or injury except as cannot be excluded by law.
- – Nothing in these Terms limits any liability which cannot legally be limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
- Force Majeure
We shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms if the delay was due to any cause beyond our reasonable control, including, but not limited to, acts of god, terrorism, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery (“Event Outside Our Control”).
- General
- – No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver, to be effective, must be in writing.
- – If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.
- – We reserve the right to alter, amend or change the Terms. The version on this website being the most up to date available.
- – These Terms together with our disclaimer and any policies we have in force from time to time constitute the entire agreement between us and you and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between us and you.
- – These Terms constitute a contract between you and us. No other person shall have the right to enforce any of these Terms.
- – These Terms shall be governed by and construed in accordance with English law and the parties hereby agree to submit the exclusive jurisdiction of the English courts.
